In 1990, George Franklin Sr., 51 years old, was tried and convicted of murder on the basis of his daughter Eileen's testimony. The victim, 8 year old Susan Kay Nason, a friend of Eileen's, had been murdered on Sept. 22, 1969. Eileen's memory of witnessing the murder had supposedly been repressed for 20 years. Eileen's confident memory had come back in a series of flashbacks. Although the basic account remained the same, some details of what happened changed over several retelling of the event. Franklin spent five years in jail. In April 1995, a San Francisco federal judge reversed his conviction.This is a true account. Reflecting on what you know about memory from Chapter 8, post a substantial response to this situation: What are the pros and cons of using repressed memories as legal evidence? Once you have looked at both sides, choose the strongest one in your opinion and post your argument.
